Emefiele finally forfeits mansions, $2m to FG

Published

on

The Supreme Court on Friday affirmed the final forfeiture of seven landed properties, $2.045 million and share certificates linked to a former Governor of the Central Bank of Nigeria, Godwin Emefiele, to the Federal Government.

In a unanimous judgment delivered by a five-member panel led by Justice Ibrahim Saulawa, the apex court set aside the judgment of the Court of Appeal and restored the earlier decision of the Federal High Court in Lagos, which had held that the assets were reasonably suspected to have been acquired with proceeds of unlawful activities.

The judgment, read on behalf of the panel by Justice Mohammed Idris, upheld the forfeiture order made by Justice Deinde Dipeolu of the Federal High Court on November 1, 2024, in Suit No. FHC/L/MISC/500/24.

Following the trial court’s decision, Emefiele had challenged the judgment before the Court of Appeal, Lagos Division, which overturned the forfeiture order.

The appellate court had held that interested parties claiming ownership of some of the assets were denied fair hearing and consequently ordered a fresh hearing of the matter.

Dissatisfied with the Court of Appeal decision, the Economic and Financial Crimes Commission approached the Supreme Court, urging it to restore the judgment of the Federal High Court.

The apex court agreed with the anti-graft agency and reinstated the forfeiture order, effectively vesting the assets in the Federal Government.

The forfeited assets include a fully detached duplex of identical structures at No. 17B Hakeem Odumosu Street, Lekki Phase 1, Lagos; an undeveloped parcel of land measuring 1,919.592 square metres covered by Survey Plan No. DS/LS/340 on Oyinkan Abayomi Drive, formerly Queens Drive, Ikoyi, Lagos; a bungalow at No. 65A Oyinkan Abayomi Drive, Ikoyi; and a four-bedroom duplex at 12A Probyn Road, Ikoyi.

Others are an industrial complex under construction on 22 plots of land in Agbor, Delta State; eight units of undetached apartments on a 2,457.60-square-metre plot at No. 8A Adekunle Lawal Road, Ikoyi; and a full duplex with all its appurtenances on a 2,217.87-square-metre plot at 2A Bank Road, Ikoyi.

The Supreme Court also affirmed the forfeiture of $2,045,000 and share certificates belonging to Queensdorf Global Fund Limited to the Federal Government.

The final forfeiture order was originally granted after the EFCC filed an application through its counsel, the Director of Public Prosecution, Rotimi Oyedepo (SAN), pursuant to Section 17 of the Advance Fee Fraud and Other Fraud Related Offences Act, 2006, and Section 44(2)(b) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended).

The application, brought as an action in rem, sought the final forfeiture of assets reasonably suspected to have been acquired with proceeds of unlawful activities.

The application was supported by an affidavit deposed to by an EFCC investigating officer, David Jayeoba, who stated that investigations revealed that the assets were reasonably suspected to have been acquired with proceeds of unlawful activities.

In its originating motion, the commission urged the court to grant the final forfeiture under Section 17 of the Advance Fee Fraud and Other Fraud Related Offences Act, 2006, contending that the assets were liable to forfeiture because they were reasonably suspected to have been acquired through unlawful means.

Justice Dipeolu granted the application on November 1, 2024, after holding that the commission had established the legal threshold required for civil forfeiture proceedings.

The case is one of several proceedings instituted against Emefiele since his removal as CBN governor in 2023.

The former apex bank chief is facing multiple criminal charges in Abuja and Lagos bordering on alleged procurement fraud, abuse of office and other financial crimes, allegations he has consistently denied.

He has also been the subject of several interim and final forfeiture proceedings initiated by the EFCC as part of its asset recovery drive.

Man arrested in connection with h@ng!ng d£ath of Mississippi mother of four

Published

on

A 51-year-old man has been arrested in connection with the d£ath of Tasia Fortune, a 29-year-old mother of four whose body was found h@ng!ng from a tree behind an abandoned home in Jackson, Mississippi.

Jackson police identified the suspect as Jacques Ratliff, who was arrested on Friday after officers executed search and arrest warrants in connection with the case.

The arrest came a day after the Mississippi State Medical Examiner officially classified Fortune’s d£ath as a h0m!cide.

Police Chief RaShall Brackney said Ratliff had an “association” with Fortune but declined to disclose the nature of their relationship. She also said the investigation remains active and that additional arrests are expected.

Fortune’s mother, Christy Spivey, said she broke down in tears after learning of the arrest, but noted that the family still has unanswered questions about the motive and evidence that led investigators to Ratliff.

Spivey last saw her daughter on July 26 during a family reunion in Kentucky, shortly before Fortune returned to Mississippi.

Fortune’s case has drawn national attention, partly because two other h@ng!ng d£aths occurred in Mississippi within the past year. Authorities ruled both those cases suicides.

Fortune, who had lived in Jackson for about 10 years after moving from Kentucky, was remembered by relatives as a religious, intelligent and athletic woman.

Ekiti CP orders probe as man allegedly kills wife during marital dispute

Published

on

The Ekiti State Commissioner of Police, Michael Falade, has ordered a thorough investigation into the alleged killing of a 25-year-old woman, Kehinde Onizeokaraga, by her husband, Sodiq Ibrahim, during a marital dispute in Ado Ekiti, the state capital.

Ibrahim, a meat seller, allegedly attacked his wife with a machete during an attempt to resolve their marital disagreement on Wednesday.

Sources who spoke about the incident on Thursday said the couple, who hailed from Kogi State, had been experiencing domestic challenges before the disagreement reportedly culminated in the fatal attack.

One of the sources said the deceased had previously left her husband’s home following what was described as irreconcilable differences between the couple.

The source said, “I am aware they had issues in the marriage to the extent that the lady had left the man’s house due to some irreconcilable differences.

“But recently, there were efforts by the suspect to resolve the issue with her, which the deceased was not comfortable with.”

The disagreement reportedly escalated into a physical confrontation during which Ibrahim allegedly attacked Kehinde repeatedly with a machete, inflicting severe injuries that led to her death.

The suspect reportedly fled the scene after the incident and remained at large as of Thursday.

The deceased’s body was said to have been deposited in a mortuary.

A cousin to the deceased, Yussuf Lawrence, said the family was devastated by the incident and appealed to the police and other relevant authorities to intensify efforts to apprehend the suspect.

Lawrence said the killing occurred during an attempt by some individuals to mediate in the couple’s marital dispute.

He said, “While Kehinde was preparing to leave Ado Ekiti, she was invited to the residence of her father’s friend, who they said wanted to see her. Kehinde went to the residence on Wednesday morning, unaware that her husband would also be present.

“An attempt to resolve the couple’s marital disagreement subsequently degenerated into the fatal attack.”

Lawrence alleged that some persons had been taken into police custody in connection with the incident, although Ibrahim was still at large.

He also alleged that Ibrahim fled with Kehinde’s mobile phone, which he said the family believed could contain information that might assist the police in their investigation.

“We want Sadiq (Ibrahim) to be found and arrested. We want justice for Kehinde. Her parents are in pain, and my family is in serious agony. She didn’t deserve this,” he said.

Confirming the incident, the Police Public Relations Officer, Ekiti State Command, Sunday Abutu, said the Commissioner of Police had ordered a thorough investigation.

“The Commissioner of Police, Michael Falade, has ordered a thorough investigation into the matter to ensure that the perpetrator is apprehended and brought to justice,” Abutu said.
