Aiyedatiwa loses bid to amend re-election eligibility suit

The Court of Appeal in Abuja has dismissed an appeal filed by the Ondo State Governor, Lucky Aiyedatiwa, challenging a ruling of the Federal High Court in Akure in a suit questioning his eligibility to contest the next governorship election in the state.

In a unanimous judgment delivered by a three-member panel, the appellate court held that the trial court properly exercised its discretion when it granted an application by the plaintiff, Dr Akindele Egbuwalo, to amend his originating summons in the case.

Egbuwalo, a chieftain of the All Progressives Congress in Ondo State, had filed a suit at the Federal High Court seeking the interpretation of Section 137(3) of the Constitution in respect of the eligibility of Aiyedatiwa and his deputy, Dr Olayide Adelami, to contest for a second term in office.

In a ruling on November 24, 2025, Justice Toyin Adegoke of the Federal High Court in Akure granted the plaintiff’s request to amend the originating processes.

Dissatisfied with the ruling, Aiyedatiwa lodged an appeal, alleging a breach of his constitutional right to a fair hearing.

He claimed the trial judge acted ultra vires her powers and wrongly assumed jurisdiction.

Owing to Aiyedatiwa’s contentions, the Court of Appeal in Akure, where the matter was initially lodged, directed the high court to halt proceedings, which were already slated for judgment.

The case was later transferred to the Abuja Division of the Court of Appeal.

Reading the lead judgment on Monday, Justice Uchechukwu Onyemenam ruled that Aiyedatiwa failed to show that the Federal High Court’s decision to allow the amendment occasioned any miscarriage of justice or denied him the right to a fair hearing.

The appellate court, therefore, dismissed the appeal for lacking merit and awarded N2m in costs against the governor.

The ruling affirmed the November 24, 2025, decision of the Federal High Court in Akure, which granted Egbuwalo leave to amend the originating summons in his suit challenging Aiyedatiwa’s eligibility for re-election.

Earlier in the proceedings, the Court of Appeal also dismissed an application filed by Aiyedatiwa, seeking to set aside an order it made on January 27, 2026, staying further proceedings in the suit before the Federal High Court.

The court held that the stay of proceedings did not amount to arresting the judgment of the trial court but was a lawful exercise of the appellate court’s jurisdiction aimed at protecting the integrity of its proceedings.

According to the court, the appeal had already been entered, records compiled, and briefs filed as of the time the order was made.

The panel further held that the order was necessary to preserve the res in the matter and prevent the appellate proceedings from being rendered nugatory.

It added that asking the Court of Appeal to set aside the order it validly made on January 27, 2026, would amount to inviting the court to sit on appeal over its own decision.

The court noted that the option available to the governor was to challenge the decision before the Supreme Court.

The panel subsequently ordered Aiyedatiwa to pay an additional N2 million in costs.

The Chief Press Secretary to the Governor, Mr Ebenezer Adeniyan, speaking with The PUNCH, said the judgment of the appellate court was not the main case of the eligibility of Aiyedatiwa to contest the 2028 governorship election at the Federal High Court, Akure.

Adeniyan said the case was still pending in the lower court.

“The main case is still in court. This was just an appeal on an amendment to the main case,” he said.

Aiyedatiwa was first sworn in on December 27, 2024, to complete the tenure of the late Governor Oluwarotimi Akeredolu.

He was subsequently inaugurated for a second time on February 24, 2025, following his victory in the governorship election held on November 16, 2024.

Although Aiyedatiwa has yet to indicate interest in running again, Egbuwalo approached the court in July 2025, insisting that Aiyedatiwa was not eligible to recontest in 2028, having already taken the oath of office twice.

The litigant sought an interpretation of Section 137(3) of the 1999 Constitution (as amended) regarding Aiyedatiwa’s eligibility to run for governor again.

Section 137(3) provides that a person sworn in as president to complete the term for which another person was elected shall only be elected to such office for a maximum of one additional term.

Meanwhile, Section 182(3) of the 1999 Constitution (as amended) stipulates that any person sworn in as governor to complete the term of another elected official is disqualified from being elected to the same office for more than a single term.

Adebutu joins Ogun governorship race for third time

The 2023 governorship candidate of the Peoples Democratic Party in Ogun State, Oladipupo Adebutu, has declared his intention to contest the state’s governorship election again in 2027.

Adebutu made the declaration in a letter dated April 30, 2026, and addressed to the party leadership in the state.

The letter, which was made available to journalists on Friday by his media aide, Afolabi Orekoya, was directed to the Ogun State Chairman of the PDP, Abayomi Tella, through the party chairman in Odogbolu Local Government Area.

The letter partly read, “As a member of the party from Ward 4, Odogbolu Local Government, I write to notify you and the State Working Committee of my intention to contest for the Office of Ogun State Governor in the 2027 general elections on the platform of the Peoples Democratic Party.

“As a law-abiding citizen and loyal member of the party, I shall continue to abide by the provisions of our party constitution and the outlined processes of the party on this journey that will eventually lead to the victory of our party in the coming general elections.

“Please accept assurances of my willingness to continue to be of good service to the party and the good people of Ogun State.”

The former lawmaker, who represented Remo Federal Constituency, said his decision was driven by a desire to offer leadership and build on his previous experience.

This will be his third attempt at the governorship seat, having contested in 2019 and 2023.

Adebutu also urged party members to remain united ahead of the next election cycle.

He assured stakeholders of his willingness to work with all factions within the party to ensure victory in the 2027 elections.

Gov Yusuf, Ganduje, others raise N50m for Tinubu’s nomination form ahead of 2027

Stakeholders of the All Progressives Congress (APC) in Kano have contributed a total of N50 million towards the purchase of nomination forms for Bola Tinubu ahead of the 2027 general elections.

The contribution was announced at a stakeholders’ meeting held at the Coronation Hall of the Kano Government House, where participants also adopted the President as the party’s sole presidential candidate for the upcoming polls.

Among those listed as part of the initiative were Kano State Governor, Abba Kabir Yusu, and a former governor of the state, Abdullahi Umar Ganduje, alongside other party leaders.

According to a statement issued by the governor’s Chief Press Secretary, Mustapha Muhammad, the meeting brought together key stakeholders who reaffirmed their commitment to the continuity of Tinubu’s administration.

A motion for the President’s adoption was moved by Rabiu Sulaiman Bichi and received unanimous backing from participants.

Speaking at the meeting, the Kano State APC Chairman, Umar Haruna Doguwa, said the state chapter had initially planned to fully fund the nomination forms but later agreed on a collective contribution.

“We have agreed to contribute the sum of N50 million towards the purchase of the expression of interest and nomination forms for President Bola Ahmed Tinubu,” he said.

Stakeholders noted that the endorsement reflected their confidence in the President’s leadership and ongoing reforms, as well as their determination to secure victory for the party in 2027.

The meeting also adopted Governor Yusuf as the party’s sole governorship candidate in Kano State, a move described as part of efforts to strengthen unity within the party ahead of the elections.

Party leaders commended members for their support and called for sustained unity to advance both the APC’s electoral prospects and the state’s development agenda.

Presidency, Peter Obi clash over FG borrowings

The Presidency and one of the leading presidential aspirants on the platform of the opposition African Democratic Congress (ADC), Peter Obi, on Thursday traded words over borrowings by the Federal Government.

The exchange came after President Bola Ahmed Tinubu defended the administration’s borrowing profile, stating that “borrowing is not leprosy.”

Reacting on his X handle, Obi said, “Mr President, borrowing is not only leprosy, but a killer cancer when it is borrowed for consumption and not production as it is in Nigeria today.”

He said one of the major “leprosy” afflicting Nigeria today is not just debt, but debt without productivity.

The 2023 presidential candidate of the Labour Party (LP) argued that no serious economy borrows recklessly, stressing that nations borrow with discipline, purpose, and a clear plan for repayment through productive investment.

Part of the post titled “When Borrowing is Leprosy and Cancerous” read:

“Borrowing for consumption slowly eats away at the health, reputation, and autonomy of a nation.

“Debt that is not tied to measurable economic value. Debt that does not translate into jobs, growth, or improved living standards for the Nigerian people.

“The Fiscal Responsibility Act 2007 provides that ‘any government in the Federation or its agencies and corporations desirous of borrowing shall specify the purpose for which the borrowing is intended and present a cost-benefit analysis, detailing the economic and social benefits of the purpose to which the intended borrowing is to be applied’.

“Cost-benefit analysis must show how the loan would be applied, how it will impact economic growth, and improve the welfare of Nigerian citizens in measurable ways.

“Most of the borrowings by this government do not satisfy the requirements of law or the requirements of economic common sense. The humongous borrowing so far does not show how the projects for the loans enhance the productive capacity of the nation and the welfare of Nigerian citizens.

“These loans are also dangerous because they burden the capacity of the Nigerian state to improve the economy in the future, as we have one of the world’s highest debt servicing ratios. What matters is not debt-to-GDP as much as debt-servicing ratio because the latter constrains our capacity to finance the sectors that drive human development and economic growth.

“If the money is wrongly spent as we do in Nigeria currently, it becomes double jeopardy because you are using current revenue to service debts that did not add to revenue or improve capacity for more production in the future.

“A responsible government does not merely defend borrowing; it explains it, justifies it, and most importantly, ensures it works for the people. A new Nigeria is possible.”

In a swift response on his X handle @aonanuga1956, the presidential spokesman, Bayo Onanuga, advised Obi to rise above what he described as a pedestrian level and address national issues with rational argument, not emotional reactions on social media.

Onanuga said the administration has been borrowing to finance much-needed infrastructure, not consumption.

“Mr Peter Obi, you have come again with your demagoguery. What point are you trying to make about borrowing? Every sovereign nation borrows, and as President Tinubu rightly said, borrowing is not leprosy. If you must know, this administration has been borrowing to finance much-needed infrastructure, not consumption.

“The fact that we are receiving funds and have willing lenders shows that our country is credible and capable of repaying. As a politician, you need to rise above the pedestrian level and address issues of the day with rational argument, not emotional reactions on the streets and Twittersphere,” he tweeted.
